Proportionality test included infederal reforms

New web-based tools to help lawyers and litigants navigate arcane court rules and bigger procedural sticks aimed at controlling abusive or wasteful litigation are among initiatives the Federal Courts expect to roll out in the coming months.
Of importance to practitioners is an amendment to the Federal Court and Court of Appeal's Rule 3 to incorporate a proportionality requirement, as well as a specific prohibition against the abusive use of Federal Court Rules (the changes likely won't kick in until 2014).
