Water damage due to undisclosed deficiencies: Are we responsible ?

I have recently rented newly constructed home from the owner. We were promised a home in a living condition .

I were not  made aware of any plumbing deficiencies in a home.

Few days ago  I run a bath in a bathroom adjacent to the master bedroom. I was in the master bedroom most of the time, briefly going to the second floor to get some drinking water and my  medication.When I came back water overflowed the bathtub completely  and filled up the floor of the bathroom with some water  escaping true the ventilation duct.

Time frame between me starting to fill up the tub and the tuboverflow is less than 10minutes. 

 The reason it all happened is because no one had told us about an overflow drain that is not functioning at all in that bathroom.  It does not drain the water period. 

I run the bath for over 25 minutes in another bathroom where overflow drain does function properly and not a drop of water overflown. 

The owner of the house expressed an opinion that it is all my fault that I should have been in the bathroom the whole time,that running a full bath is an extremely bad idea  and wants  me to to pay for all the damages

 My questions with all this are

 

1) It is my understanding that before the sale of the home the builder is responsible to disclose any deficiencies to the owner

2) Does the owner has a responsibility to check if everything functions properly in his home before he rents it out.

3)How much of the blame for this accident lies on me and what kind of outcome can i expect.
