Wants to pursue sole-custody but not sure how...

My ex and I split up in September of 2011 and since that time our children have been living with me. I am the sole-decision maker as well as the primary caregiver, which is also how it was even while we were together. With that being said...

I would like to pursue sole-custody of our children not only for the reasons stated above but because the other parent has become very distant and absent in the childrens' lives. It's been far far worse over the last 2.5 months but it had been something that was going on for awhile. Also, the children have expressed to not only myself but counsellors that they do not wish to have overnights at the other parents house but still want to see the other parent.

I truly feel this is in the best interest of the children but in no way am I trying to take the children from the other parent. I'm just trying to do what's right for the children and make this as painless as possible for them. I want them to see the other parent but don't want to put them in the same state of mind that they were in before the overnights ended.

I just don't know how to go about this... Should I try and discuss this with my ex and hope that he/she agrees or should I just pursue court?
