Young Offender Break and Enter

My 13 yr old son is charged with break and enter.  While doing newspapers He found the key in mailbox and was curious, entered, and relieved himself sexually in her bedroom.  He is a good kid, never in any trouble, but does have difficulty with impulsiveness and other ADHD diagnosed symptoms.  I have already secured counselling for help for him.  At first the Crown was consideriing Diversion for punishment, but is no wanting 12 mos probation.  I understand reasonable punishment but is it unrealistic to ask for discharge or record after probation is completed successfully?  I don't want him to have a record as an adult for a stupid mischievious mistake he made.  Please help...if we have a chance we will get a lawyer, to at least fight for record discharge.
